Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Atlas EP iOS application ("App" or "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Atlas Glinn, LLC ("Atlas Glinn," "we," "us," or "our").

2. Eligibility

You must be at least 18 years old to create an account and use Atlas EP. By using the App, you represent that you are 18 or older and have the legal capacity to enter into this agreement. Atlas EP is designed for licensed and trained security professionals. Use of the App in connection with unlawful activities is strictly prohibited.

3. Account Registration

3.1 Account Creation

You may create an account via the web-based signup page at atlasglinn.com/signup, as required by Apple App Store guidelines for account-based services. You must provide accurate, complete, and current information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify Atlas Glinn immediately at support@atlasglinn.com if you suspect unauthorized access to your account. Atlas Glinn is not liable for losses resulting from unauthorized account access due to your failure to safeguard your credentials.

3.3 One Account Per User

Each individual user may maintain one active account. Team accounts and multi-user configurations are managed through Team and Command plan tiers at the organization level.

4. Subscription Plans & Billing

4.1 Plan Tiers

Atlas EP offers the following subscription tiers:

• Single ($29/mo) — Individual operator access
• Family ($79/mo) — Up to 5 family members with EP monitoring
• Agent ($99/mo) — Professional agent with full feature access
• Operator ($249/mo) — Small team up to 5 agents
• Command ($499/mo) — Enterprise team up to 20 agents
• Sovereign (Custom) — Unlimited seats, custom integrations, dedicated support

4.2 Billing

Subscriptions are billed monthly or annually (annual plans receive a discount). Payment is processed by Stripe, Inc. Your subscription renews automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.

4.3 Refunds

We offer a 7-day money-back guarantee for new subscriptions. After 7 days, subscription fees are non-refundable. In-app purchases made through the Apple App Store are subject to Apple's refund policy.

4.4 Price Changes

We may change subscription prices with 30 days' advance notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.

5. Permitted Use

Atlas EP is licensed for use by licensed security professionals, executive protection agents, and their clients. You may use the App to:

• Coordinate protective security operations
• Track team member locations during authorized deployments
• Communicate securely with authorized team members
• Monitor threats and security conditions relevant to your principals
• Respond to emergencies within your authorized scope of operations

6. Prohibited Use

You may not use Atlas EP to:

• Stalk, harass, or surveil individuals without their knowledge and consent
• Track individuals who have not authorized such monitoring
• Conduct illegal surveillance or gather intelligence in violation of applicable law
• Violate any federal, state, local, or international law or regulation
• Impersonate another person or organization
• Reverse engineer, decompile, or attempt to extract source code from the App
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Transmit malware, viruses, or any other harmful code
• Resell, sublicense, or transfer your account to another party without written consent
• Use the App for any purpose that Atlas Glinn determines, in its sole discretion, to be harmful or inappropriate

7. Emergency Features Disclaimer

Atlas EP's SOS, emergency response, and threat-monitoring features are tools designed to assist trained security professionals. They are not a substitute for calling 911 or official emergency services. In any life-threatening emergency, always contact official emergency services first. Atlas Glinn is not liable for the failure of emergency features due to connectivity issues, device failure, or user error.

8. Location Services

By enabling location features, you consent to the collection and sharing of your location data with authorized team members as described in our Privacy Policy. You are responsible for obtaining consent from any individuals whose location data you monitor or share through the App. Unauthorized tracking of individuals is a violation of these Terms and may be a violation of applicable law.

9. Intellectual Property

Atlas EP, including all software, design, content, trademarks, and trade dress, is the exclusive property of Atlas Glinn, LLC, protected by U.S. and international intellectual property laws. These Terms do not grant you any ownership interest in the App. You receive a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

10. User Content

You retain ownership of any content, data, or communications you submit through Atlas EP. By submitting content, you grant Atlas Glinn a limited license to process and store that content solely for the purpose of providing the Service. We do not claim ownership of your operational data.

11. Third-Party Services

Atlas EP integrates with third-party services including Google Firebase, Stripe, Twilio, Apple services, and Anthropic AI. Your use of these integrated services is subject to their respective terms of service and privacy policies. Atlas Glinn is not responsible for the practices or content of third-party services.

12. Disclaimer of Warranties

ATLAS EP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ATLAS GLINN DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS GLINN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE ATLAS EP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO ATLAS GLINN IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Atlas Glinn, LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of Atlas EP, your violation of these Terms, or your infringement of any third-party right.

15. Termination

Atlas Glinn reserves the right to suspend or terminate your account at any time for violation of these Terms, without notice and without liability. You may terminate your account at any time by contacting support@atlasglinn.com. Upon termination, your license to use the App immediately ceases. Sections 9, 12, 13, 14, and 17 survive termination.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via the App or email at least 14 days before they take effect. Continued use of Atlas EP after updated Terms take effect constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of Atlas EP shall be resolved through binding arbitration in Houston, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
